TERMS OF TRADE

Lainee Hermsen Bridal Design Limited advises the following are the terms and conditions applying to the customer’s order for wedding and bridal clothing, accessories, or any other goods or products provided to the customer.

All customers need to read and are deemed to have agreed on the following terms and conditions at the time of ordering the goods.

Definitions

The “gown” includes wedding and bridal gowns, dresses, clothing and any accessories supplied or produced by the company for the customer.

The “company” means Lainee Hermsen Bridal Design Limited.

All deliveries including international will be signed and tracked, and arrive within a week of dispatch. An email will be sent to confirm when the gown is on its way. Production time is 6 to 10 weeks.

Insurance on the dispatch/courier delivery is covered within NZ, and if you are an overseas customer please choose the insured shipping option for your country if you wish to be fully covered. International customers may be contacted by DHL to pay for customs charges or taxes incurred on arrival at port.

The gown will be produced to professional tailor standards according to the measurements given by the customer at the time of the purchase order.

The company is dependent on the customer giving accurate measurements in order for it to manufacture and produce the gown for the customer.

The company will endeavour to provide the best possible fit of the gown which may necessitate minor alterations from time to time to accommodate any differences in body shape.

If the customer’s measurements change from the time between the order and the arrival of the gown, it is the responsibility of the customer to have it made to fit, there will be no refunds given if the measurements are incorrect or if the customer has a change of mind as to the style of gown produced.

It is advisable to have measurements taken by a professional tailor, a measurement chart and body image form will be provided by the company using measurements in centimetres, it is most important that the customer does not use another size chart and does not complete the measurement in inches, and that the instructions are followed closely.

If alterations are required and the company judges that it is at fault, the company will cover the cost or offer alterations free of charge but any other alterations will be made at an additional cost to the customer.

In the event that the customer requires a variation or alteration to the gown the customer shall advise in writing or email details of the variation.

The company shall not be liable to the customer or any other person for any loss or damage either:

Caused by delay in delivery however that delay is caused; or

Arising directly or indirectly from the production and manufacture or delivery or non-delivery of the gown or their use.

Any claim by the customer as to incorrect performance or breach of this contract must be made to the company in writing within five (5) days of completion or delivery of the gown with time being of the essence otherwise the company shall be entitled to presume the gown has been delivered in good order and without defect in quality.

If the company shall fail to perform any obligations imposed on it and such failures are caused by acts of god, strikes, earthquakes, floods or any act of government or any other cause beyond the reasonable control of the company, then the company shall be exempt from all liability to the extent due or arising from such failures.
